Data Protection

The Data Protection Act 1998 (DPA) applies to personal data.

Personal data is any information which is capable of identifing a living individual e.g. name and address, audio or video recording, CCTV image, email address, postcode, photograph etc.

Information which is about you and identifies you is your personal data.

 

The Data Protection Act 1998 covers the collecting, storing, processing and distribution of personal data. It gives rights to individuals about whom information is recorded.

The Act gives individuals the right to ask any organisation which processes personal data about them for a copy of that information.

Fife Council has a responsibility to ensure that it complies with the Act.

 

Subject Access Requests

The Data Protection Act also allows people to find out what personal information is held by organisations about them by making a Subject Access Request. A SAR can include electronic information and paper records. The organisation must provide the information within 40 calendar days (there are some exceptions to this).

Data Subjects who wish to make a SAR to Fife Council will need to provide evidence of their identity. There is no charge for the first SAR made by a data subject to Fife Council. However repeat requests, particularly detailed requests or multiple requests made over a short period of time, may incur a small charge (£10). Fees will be applied on a case by case basis.

The Information Commissioner promotes public access to official information and protects personal information. The ICO (Information Commissioner’s Office) is an independent body with specific responsibilities set out in the Data Protection Act 1998.
